About this course.

Sometimes, keeping a person who lacks capacity safe means restricting their freedom to the point where they are, in law, deprived of their liberty. When that happens in a care home or hospital it must be done lawfully — and the Deprivation of Liberty Safeguards (DoLS) exist to make sure it is, protecting some of the most vulnerable people from being detained without proper checks. This course explains the background in the Mental Capacity Act, what ‘deprivation of liberty’ means, and why DoLS exist.

It then covers the ‘acid test’ set out by the Supreme Court and how to recognise when DoLS apply, the authorisation process and the assessments and people involved, and the rights and safeguards that protect the person — including the relevant person's representative, advocacy and the right to challenge. It also looks at good practice and the future move towards Liberty Protection Safeguards. It is an awareness-level course that helps care and health workers recognise a possible deprivation of liberty and act lawfully.
